Enduring Powers of Attorney
An Enduring Power of Attorney is a legal document which sets out who can take care of your personal and financial matters if you can’t. By having a power of attorney, you can choose someone you trust to take on these important life decisions on your behalf.
There are two kinds of Enduring Powers of Attorney. Most people would elect to have both completed at the same time, as they both cover very different matters.
The first kind is an Enduring Power of Attorney for Personal Care and Welfare, which will only ever come into effect if a doctor considers you are mentally incapacitated and unable to make medical, health and welfare decisions for yourself.
The second kind relates to your property and finances. An Enduring Power of Attorney for Property can come into effect at any time you choose, either immediately, or only when you are mentally incapacitated. An Enduring Power of Attorney for Property can be particularly useful, both in the event you lose mental capacity, or if you are simply physically unwell and unable to tend to your own affairs.
